These Terms of Service (“Terms”) govern your access to and use of the Excellent Brain website (the “Website”) and any services, features, or content offered by Excellent Brain (collectively referred to as the “Service”). Please read these Terms carefully before using the Website or Service.

By accessing or using the Website or Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Website or Service.

Excellent Brain reserves the right to modify, update, or replace these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Website. Your continued use of the Website or Service after any such changes constitutes your acceptance of the revised Terms.

The Website and Service are intended for individuals who are at least 18 years old or the legal age of majority in their jurisdiction. By using the Website or Service, you represent and warrant that you meet this eligibility requirement.

If you are using the Website or Service on behalf of an organization (such as an educational institution, school, or neurofeedback training clinic), you represent and warrant that you have the necessary authority to bind that organization to these Terms.

In order to access certain features, games, training protocols, or secure client/trainer dashboards on the Website, you may be required to create a user account. You agree to:

• Provide accurate, complete, and up-to-date information during the registration and profiling process.
• Protect and maintain the strict confidentiality of your account credentials (passwords, usernames).
• Acknowledge that you are solely responsible for all activities and telemetry uploads that occur under your registered account.

The Website and Service may allow users to submit, post, or share content, including but not limited to text feedback, system diagnostics, user surveys, images, videos, and links (collectively referred to as “User Content”).

You retain ownership of any intellectual property rights that you hold in your User Content. By submitting User Content, you grant Excellent Brain a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the operations, validation studies, and optimization of the Service.

You agree not to engage in any of the following prohibited conducts when operating our software, services, or website:

The Website and Service, including but not limited to the proprietary neurofeedback game designs, software applications, brand logos, vector graphs, training curricula, hardware firmware, visual assets, text descriptions, and interactive elements, are the exclusive property of Excellent Brain Ltd. and are protected by applicable patent, copyright, trademark, and trade secret laws.

You may not copy, reverse engineer, extract software source code, republish, distribute, or create derivative works from any content or materials found within the Service without explicit, prior written authorization from Excellent Brain.

The Website or Service may contain references or hyperlinks to third-party web domains, applications, educational tools, or scientific journals.

Excellent Brain does not endorse, verify, or assume any operational responsibility for the accuracy, security protocols, cookie modules, or general activities of third-party platforms. You acknowledge and agree that Excellent Brain shall not be held liable, directly or indirectly, for any losses or damages caused by using external sites.

The Website and Service are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory.

Excellent Brain explicitly disclaims all warranties to the fullest extent permitted by law, including but not limited to implied warranties of merchantability, fitness for a specific diagnostic or clinical purpose, and non-infringement. We do not guarantee that the training interface will be completely free of visual lag, system outages, hardware-to-app connection hiccups, or that training results are guaranteed for every single individual.

To the maximum extent permitted by applicable laws, Excellent Brain, including its software developers, founders, parent companies, partners, and medical advisers, shall not be held liable for any direct, indirect, special, incidental, punitive, or consequential damages.

This limitation includes, but is not limited to, damages resulting from:

• Loss of operational profits, commercial goodwill, account focus data, or physical device values.
• Software malfunctions, signal dropout, bluetooth coupling failures, or server-side sync disruptions.
• Any unauthorized server intrusion, hardware tampering, or data compromise.

You agree to indemnify, defend, and hold harmless Excellent Brain Ltd., its board members, corporate affiliates, third-party clinic partners, shipping distributors, and technical staff from and against any third-party claims, legal processes, damages, liabilities, costs, or attorney fees arising from your inappropriate use of the Service, violation of these Terms, or infringement of copyright or health regulations.

These Terms, including any related contractual processes, updates, platform registrations, or device licenses, shall be exclusively governed by and construed in accordance with the laws of Israel.

Any legal dispute, suit, or claim arising out of or connecting to these Terms or the use of Excellent Brain technologies shall be exclusively resolved in the competent court systems located in Israel.

If any provision, paragraph, or clause in these Terms is identified as invalid, unlawful, or legally unenforceable by a court of competent jurisdiction, that specific provision shall be limited or severed to the minimum extent necessary. The remaining sections of these Terms shall continue in full force and effect.

These Terms of Service constitute the complete and exclusive agreement between you and Excellent Brain regarding the usage of our software, devices, databases, and website. They entirely supersede and replace any prior verbal, written, or structural communications, proposals, or understandings.

• Shipping: Delivery will be completed within 14 business days.
• Consumer Protection: All terms are subject to the provisions of the Israeli Consumer Protection Law, 5741-1981.
• Non-Refundable Items: Please note that cancellations or refunds are not available for monthly subscriptions and/or training sessions.
